By accessing or using WorkSafe Log ("Service", "Platform", "Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Service Description
WorkSafe Log is a personal workplace incident documentation platform that allows users to:
- Document workplace incidents with detailed records
- Track people involved (involved parties, witnesses, reported individuals)
- Store evidence and attachments
- Generate professional reports (Legal PDF, HR DOCX, Timeline PDF)
- Share incidents securely with authorized parties
- Use AI-powered features for tone revision, redaction analysis, and pattern detection
3. User Accounts and Security
3.1 Account Registration
- You must provide accurate, current, and complete information during registration
- You must be at least 18 years old to use the Service
- You are responsible for maintaining the confidentiality of your account credentials
- You must enable Two-Factor Authentication (TOTP) for enhanced security
3.2 Account Responsibilities
- You are solely responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized access or security breach
- You must not share your account credentials with others
- You must not create multiple accounts for deceptive purposes
4. Acceptable Use
4.1 Permitted Uses
You may use the Service to:

- Track interactions with colleagues, supervisors, and HR personnel

- Share incident documentation with authorized legal or HR professionals

You must NOT:
- Create false, misleading, or fabricated incident reports
- Harass, defame, or abuse any individual through the Service
- Use the Service to violate any laws or regulations
- Attempt to gain unauthorized access to the Service or other users' data
- Upload malicious code, viruses, or harmful content
- Use the Service for any commercial purpose without authorization
- Scrape, copy, or extract data from the Service using automated means
- Impersonate any person or entity
- Use the Service to violate employment contracts or non-disclosure agreements
5. Data Ownership and Rights
5.1 Your Data
- You retain all ownership rights to the incident data you create
- You are solely responsible for the accuracy and legality of your incident reports
- You grant us a limited license to process, store, and transmit your data as necessary to provide the Service
5.2 Platform Rights
- We own all rights to the Service, including software, design, and functionality
- You may not copy, modify, distribute, or reverse-engineer any part of the Service
- All trademarks, logos, and brand elements are our property
5.3 Use of Non-Personal Data
- We may use aggregated, anonymized, and non-personal data for market research, analytics, and product improvements
- We may use non-personal data for promotional purposes and to understand user behavior patterns
- This non-personal data does not identify you individually and does not include your incident content or personal information
- We will never sell or share your personal data or incident documentation with third parties
6. AI Features and Limitations
6.1 AI-Powered Features
The Service uses artificial intelligence (Google Gemini API) for:
- Legal tone revision (converting emotional language to professional tone)
- PII detection and redaction recommendations
- Related incident detection using semantic similarity
6.2 AI Disclaimers
- AI-generated content is provided as a suggestion only
- You are responsible for reviewing and verifying all AI-generated content
- AI features may produce inaccurate or incomplete results
- We do not guarantee the legal adequacy or accuracy of AI-revised content
- AI features should not replace professional legal or HR advice
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the Service will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy, reliability, or completeness of any content or AI-generated results
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
11.1 No Liability for Damages
WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or business opportunities
- Employment termination or disciplinary action
- Legal disputes or litigation costs
- Emotional distress or reputational harm
- Damages resulting from unauthorized access or data breaches
11.2 Maximum Liability Cap
Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
11.3 No Guarantee of Legal Outcomes
- We do not guarantee that incident documentation will result in favorable legal or HR outcomes
- The Service is for record-keeping purposes only and does not constitute legal advice
- You should consult qualified legal professionals for legal guidance
12. Indemnification
You agree to indemnify, defend, and hold harmless WorkSafe Log, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms
- Your violation of any law or regulation
- Your violation of any third-party rights
- Any false or misleading information in your incident reports
- Any content you upload or share through the Service
- Your use or misuse of AI-generated content
16. Dispute Resolution

16.2 Arbitration Agreement
- Any disputes arising from these Terms or the Service shall be resolved through binding arbitration
